We collect and use your personal data exclusively in accordance with data protection laws. Please read below about the type, scope and purpose of the collection and use of personal data. You may access and/or store and/or print this information from our website at any time.

Collection and use of non-personal data for internal and statistical purposes

When you visit IPG Automotive GmbH’s website or download data from these webpages, we will store and process information about this in a log file. For visits to our website, we automatically collect and save server log files, which are automatically transferred to us by your browser. Depending on the type of access, these may include: browser type, operating system used, reference URL, IP address and time of the server request and, if applicable, the access status of the web server, the name of the requested file and the data volume transferred.

The data will only be stored for reasons of data security as well as to be evaluated for internal statistical purposes and will only be stored for a limited duration of three months, after which they will be automatically deleted. The process is fully anonymized. Therefore, it is not possible to draw any conclusions about your identity.

Collection and use of personal data

Whenever processing of personal data is required and there is no legal basis for such processing, we will generally seek the consent of the person concerned (“data subject”).

You may be asked to provide personal information when using our services. The provision of such information is voluntary. Your personal data will be stored and processed in accordance with the General Data Protection Regulation and in compliance with the country-specific data protection laws applicable to IPG Automotive GmbH. Personal data are always treated as confidential and are used only for a specific purpose, i.e. if you were to send a request, your information would only be used to respond to this request.

Data obtained during the registration process will be saved on a web server, as the login data are used for logging into our start page. Log files will be stored on the FTP server.

If you register for IPG Automotive GmbH’s newsletter, the data provided will be used for sending newsletters only. Your data will only be stored locally.

We will not pass on data to third parties or use them for other purposes. If you have given consent to IPG Automotive GmbH, you may withdraw such consent at any time (a link for unsubscribing is included at the bottom of every newsletter).

It is our company’s intention, through this data protection statement, to inform the general public about the nature, scope and purpose of the personal data which we collect, use and process. This data protection statement additionally informs data subjects about their rights.

Being responsible for the processing of these data, IPG Automotive GmbH (as the “data controller”) has taken numerous technical and organizational measures to ensure that the personal data processed via this website are protected as completely as possible. Notwithstanding, it is a fundamental fact that internet-based data transmissions may be subject to security loopholes, making it impossible for us to guarantee absolute protection. For that reason, each data subject is at liberty to transmit personal data to us via alternative means, e.g. by telephone.

Right of revocation

Anyone concerned by the processing of personal data has the right, granted by the European issuer of Directives and the European regulator, for reasons connected with their specific situation, to object at any time to the processing of personal data concerning them, carried out in connection with point (e) or (f) of Article 6(1) of the General Data Protection Regulation (GDPR). This also applies to profiling based on these laws.

You have the right to withdraw your consent for collecting and using personal data with future effect at any time. To do so, please contact us by post, or send an e-mail to data-protection@ipg-automotive.com.

If an objection is received, IPG Automotive GmbH shall cease processing of personal data unless we are able to provide compelling and legitimate reasons for such processing which outweigh the interests, rights and freedoms of the data subject, or if such processing is for the purpose of asserting, exercising or defending legal claims.

If IPG Automotive GmbH processes personal data for the purpose of direct advertising, the data subject is entitled to object at any time to the processing of personal data for the purpose of such advertising. If the data subject contacts IPG Automotive GmbH to object to processing for the purpose of direct advertising, IPG Automotive GmbH shall cease processing of personal data for such purposes.

The data subject also has the right for reasons connected with his or her specific situation, to object to the processing of personal data concerning them, carried out at IPG Automotive GmbH for scientific research purposes or for statistical purposes in accordance with Article 89(1) of the General Data Protection Regulation, unless such processing is required in order to perform a task which is in the public interest.

Right of access to data

Upon request by the data subject, IPG Automotive shall inform that person what personal data are stored in his or her regard. Further, European issuers of Directives and European regulators have ruled that access to the following information shall be granted to data subjects:

  • the purpose of the processing;
  • the categories of personal data concerned;
  • the recipients or categories of recipient to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations;
  • where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;
  • the existence of the right to request from the controller rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing;
  • the right to lodge a complaint with a supervisory authority;
  • where the personal data are not collected from the data subject, any available information as to their source

The data subject is further entitled to know whether personal data have been transmitted to any third countries or international organizations. If this is the case, the data subject also has the right to obtain information about appropriate guarantees in connection with such transmission.

Rectification, blocking and erasure of data

IPG Automotive GmbH shall only process and store personal data in relation to the data subject for the period required to achieve the purpose of storage, or for the period prescribed by the European issuers of Directives or the European regulators or any other legislator of laws and provisions which apply to the data controller.

If the purpose of storage no longer exists, or if a storage period prescribed by European issuers of Directives or European regulators, or by any other competent legislator expires, the personal data shall be routinely blocked or erased in accordance with the statutory provisions.

You may have the right to demand rectification, blocking or erasure of your personal data free of charge.

Right to confirmation

European issuers of Directives and European regulators accord everyone concerned the right to demand confirmation from IPG Automotive GmbH whether or not personal data are processed. If a data subject wishes to exercise this right to confirmation, he or she may send an email at any time to data-protection@ipg-automotive.com.

 

Right to rectification

Anyone concerned by the processing of personal data has the right, granted by the European issuers of Directives and European regulators, to demand immediate rectification of incorrect personal data. Further, the data subject is entitled, taking account of the purposes of processing, to demand completion of incomplete personal data — by means of a supplementary statement if need be.

Right to erasure (right to be forgotten)

Anyone concerned by the processing of personal data has the right, granted by the European issuers of Directives and European regulators, to demand of the data controller that the relevant personal data be erased immediately to the extent that one of the following reasons applies and processing is not necessary:

  • The personal data were collected for purposes, or otherwise processed, for which they are no longer required.
  • The data subject withdraws consent on which the processing is based according to point (a) of Article 6(1), or point (a) of Article 9(2), and where there is no other legal ground for the processing.
  • The data subject objects to the processing pursuant to Article 21(1) GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) GDPR.
  • The personal data have been unlawfully processed.
  • The personal data have to be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject.
  • The personal data have been collected in relation to the offer of information society services referred to in Article 8(1) GDPR.

To the extent that one of the above-mentioned reasons applies and a data subject wishes to request erasure of personal data stored by IPG Automotive GmbH, he or she may send an email at any time to data-protection@ipg-automotive.com. IPG Automotive GmbH shall ensure immediate compliance with the request for erasure.

If personal data have been made public by IPG Automotive GmbH, and if our company, as the data controller pursuant to Article 17(1) GDPR, has an obligation to erase this personal data, then IPG Automotive GmbH shall take appropriate measures, having regard to the technology available and the cost of implementation, including of a technical nature, to alert other data controllers engaged in processing the published personal data to the fact that the data subject has demanded that these other controllers should delete all links to such personal data or copies or replications of this personal data in so far as such processing is not necessary. The IPG Automotive GmbH employee shall take the necessary action in each individual case.

Your personal data will be erased if you withdraw your consent to your data being stored, if having your data is no longer necessary for the purpose for which they were stored, or if storing your data is, or becomes, inadmissible on other legal grounds.

Right to restriction of processing

Anyone concerned by the processing of personal data has the right, granted by the European issuer of Directives and the European regulator, to demand restriction of processing from IPG Automotive GmbH in any of the following situations:

  • The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.
  • The processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead.
  • The controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defense of legal claims.
  • The data subject has objected to processing pursuant to Article 21(1) GDPR and it has not yet been verified whether the legitimate grounds of the controller override those of the data subject.

Where one of the above-mentioned situations arises and a data subject wishes to demand a restriction on the use of personal data stored by IPG Automotive GmbH, he or she may send an email at any time to data-protection@ipg-automotive.com. IPG Automotive GmbH shall take action to restrict the processing of such personal data.

Right to data portability

Anyone concerned by the processing of personal data has the right, granted by the European issuer of Directives and the European regulator, to obtain relevant personal data made available to a data controller by the data subject, in a structured, commonly used, machine-readable format. He or she also has the right to transfer these data to another data controller without hindrance by the original data controller to whom the personal data were made available, providing the processing is based on consent pursuant to point (a) of Article 6(1) GDPR or point (a) Article 9(2) GDPR or on a contract pursuant to point (b) of Article 6(1) GDPR and the processing is carried out by automated means, providing the processing is not required for the performance of a task carried out in the public interest or in the exercise of official authority invested in the data controller.

When exercising his or her right to data portability pursuant to Article 20(1) GDPR, the data subject shall also have the right to have the personal data transmitted directly from one data controller to another to the extent that this is technically feasible and providing the rights and freedoms of other persons are not affected by such action.

The data subject may contact an employee of IPG Automotive GmbH at any time with a request to exercise his or her right to data portability.

Registration on our website

The data subject may register on our website by providing personal data. The type of personal data transmitted to the data controller during registration may be seen from the input screen used for registration. Personal data entered by the data subject are for internal use only, and are collected and stored for our own purposes. IPG Automotive may transfer the data to one or more processors, e.g. a parcel service provider, who shall also use the personal data exclusively for internal purposes associated with IPG Automotive.

When registering on our website, the IP address attributed by the person’s Internet Service Provider (ISP), the date and the time of registration are also stored. These data are stored because this is the only way of preventing misuse of our services, and these data may, if required, enable clarification of any offences which may be committed.

To this extent, storage of such data is required to ensure our own security. As a general rule, these data are not transferred to third parties unless there is a statutory obligation to make such a transfer, or the transfer is required in connection with law enforcement.

Registration of the data subject with voluntary provision of personal data enables the provision of content or services which, given the nature of the matter, may only be offered to registered users. Registered persons are free to amend personal data provided during the registration process at any time, or to have them completely erased from the IPG Automotive database.

Subscription to our Newsletter

On the website of IPG Automotive GmbH, users are invited to subscribe to our company newsletter. The type of personal data transmitted to the data controller when subscribing to the newsletter may be seen from the input screen used for subscription.

IPG Automotive GmbH uses its newsletter to inform customers and business partners about company offers at regular intervals. As a general rule, the data subject can only receive our company newsletter if (1) the data subject has a valid email address and (2) the data subject registers to receive the newsletter. For legal reasons, anyone providing an email address for the first time in order to receive our newsletter will be sent a confirmation email as part of a double-opt-in procedure. This confirmation email serves to verify if the owner of the email address did in fact authorize receipt of the newsletter as the data subject.

When subscribing to the Newsletter, we also store the IP address as allocated by the Internet Service Provider (ISP) to the computer system used by the data subject at the time of subscription, as well as the date and time of subscription. Collection of these data is required in order to prove the subsequent (possible) misuse of the email address of a data subject, and therefore serves as a legal safeguard for the data controller.

The personal data collected during subscription to the newsletter will be used only for sending out our newsletter. Newsletter subscribers may additionally be informed by email, to the extent that this is required for the operation of the newsletter service or a related registration, as might be the case in the event of changes to the newsletter offer or the technical circumstances. Personal data collected in connection with the newsletter service will not be communicated to third parties. The data subject may cancel his or her subscription to our newsletter at any time. The consent provided by the data subject with respect to the storage of personal data in connection with the newsletter may be withdrawn at any time. Every newsletter features an ‘unsubscribe’ link which may be used for the purpose of withdrawing consent.

Newsletter tracking

IPG Automotive GmbH newsletters contain tracking pixels. A tracking pixel is a miniature graphic embedded in emails sent in HTML format in order to allow log file recording and analysis. This enables statistical evaluation of the success or otherwise of online marketing campaigns. Using the embedded tracking pixel, IPG Automotive GmbH can detect whether and when an email was opened by someone and which links in the email were activated by that person.

Such personal data collected via tracking pixels contained in the newsletters are stored and evaluated by IPG Automotive GmbH in order to optimize the newsletter service and to make the content of future newsletters even better adapted to the interests of the data subject. These personal data will not be communicated to third parties. Data subjects are entitled at any time to withdraw the separate consent provided via the Double-Opt-In procedure. In the event of revocation, these personal data will be erased by IPG Automotive GmbH. IPG Automotive GmbH shall automatically regard the act of unsubscribing from the newsletter as a revocation.

Contacting us via our website

If IPG Automotive GmbH enters into a contract of employment with an applicant, the data transmitted will be stored for the purpose of handling the employment relationship with due regard to the statutory provisions. If a contract of employment is not concluded with the applicant, the application documents will be automatically deleted four months after notification of rejection as long as no other justified interests of IPG Automotive GmbH stand in the way of such deletion. A justified interest in this context would be, for example, a burden of proof in proceedings pursuant to the German General Equal Treatment Act (AGG).
